Eligibility and accounts
You must be legally able to enter into these terms. You are responsible for the accuracy of information you provide, protecting your password, and all activity under your account. Notify support promptly if you suspect unauthorized access. Up Set may suspend access reasonably necessary to protect users, the service, or third parties.
What Up Set provides
Up Set provides catalog information, collection and cost tracking, market references, watchlists, target-price alerts, and related tools. Features, supported items, and data coverage may change. Camera recognition and barcode results are aids and should be confirmed before an inventory change.
Prices are references, not guarantees
Up Set values are estimates based on evidence available to the published pricing model. They are not appraisals, financial advice, tax advice, investment recommendations, offers to buy or sell, or guarantees that an item can be purchased or sold at a displayed amount. Condition, completeness, shipping, taxes, location, seller reputation, and marketplace fees can materially affect an actual transaction.
Your information and profile photo
You retain your rights in information you enter about your collection and any profile photo you upload. You authorize Up Set to store, process, resize, and display that information as needed to operate and synchronize your account. You must have the right to use an uploaded photo and may not upload unlawful, infringing, deceptive, or abusive content. You are responsible for checking quantities, purchase prices, and other entries before relying on a collection total.
Acceptable use
You may use Up Set for lawful personal or internal business purposes. You may not disrupt or probe the service, bypass access controls, access another person’s account, submit malicious content, misuse scanner or identification features, or automate abusive traffic.
Data use and automated access
Except through functionality Up Set expressly provides or under a written agreement, you may not use robots, crawlers, scrapers, scripts, browser automation, or other automated means to access the service; bulk download, mirror, harvest, or systematically extract Up Set catalog records, published values, pricing outputs, organization, or other service content; create or maintain a substitute or competing database or service from Up Set; sell, license, syndicate, or republish those materials; use them to train, fine-tune, evaluate, or supply an artificial-intelligence or machine-learning system; or circumvent authentication, rate limits, robots directives, technical safeguards, or other access restrictions.
Ordinary personal use and authorized internal business use remain permitted. Bona fide public search engines may index public pages in accordance with Up Set’s robots directives. Rights in third-party trademarks, images, and individual catalog facts remain with their respective rights holders. This section governs access to and use of the Up Set service and its protected software, original content, compilation, organization, and pricing outputs. Third-party services and affiliate links
Retailer, marketplace, data-provider, and other third-party services have their own prices, availability, terms, and policies. Up Set is not the seller and is not responsible for third-party listings, inventory, authenticity, fulfillment, returns, or representations. Up Set may earn a commission from clearly disclosed affiliate links at no additional cost to you.
Intellectual property
The Up Set name, logos, interface, software, original writing, organization, and pricing presentation are owned by Up Set or its licensors. Product names, trademarks, catalog facts, and imagery may belong to their respective owners. Permission to use Up Set does not grant rights in third-party content or permit copying the service.
Feedback
If you voluntarily provide suggestions, you allow Up Set to use them without restriction or compensation, while you retain ownership of any rights you already hold.
Availability and changes
Up Set may add, change, pause, or discontinue features and may correct catalog or pricing errors. We may update these terms by posting a revised version and effective date. Continued use after an update constitutes acceptance of the revised terms.
Disclaimers and limitation of liability
To the extent permitted by law, Up Set is provided “as is” and “as available” without warranties of uninterrupted operation, completeness, accuracy, merchantability, fitness for a particular purpose, or non-infringement. To the extent permitted by law, Up Set and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from use of the service, third-party transactions, or reliance on displayed values. Rights that cannot lawfully be waived remain unaffected.
Indemnity
To the extent permitted by law, you agree to be responsible for claims and reasonable costs arising from your unlawful misuse of Up Set, infringement of another person’s rights, or material violation of these terms.
